Terms of Service
Terms governing your use of 9MM Pro's interface and services.
Last updated: 2026-04-12
By accessing or using 9MM Pro — including 9mm.pro, dex.9mm.pro, 9x.9mm.pro, claim.9mm.pro, index-api.9mm.pro, any other 9MM-operated domain, or any front-end that interacts with the 9MM Pro smart contracts — you ("you", "your", "User") agree to the following terms. If you do not agree, do not use the protocol.
1. Definitions
| Term | Meaning |
|---|---|
| "Protocol" | The smart contracts comprising 9MM Pro's V2, V3, V4, StableSwap, OG NFT, PUSSY 404, 9x aggregator, and claim contracts, across every supported chain |
| "Interface" | The websites, applications, APIs, and related tools operated by the 9MM Pro team that provide access to the Protocol |
| "Wallet" | A self-custody cryptocurrency wallet used to sign transactions |
| "Restricted Person" | A person subject to any Sanctions regime, or located in any Restricted Jurisdiction |
2. The Interface Is Not The Protocol
An important distinction: the Protocol is an autonomous, permissionless set of smart contracts deployed to public blockchains. It will continue to function even if the Interface is taken down. These Terms govern your use of the Interface — not the underlying Protocol, which anyone can interact with directly via their own tooling.
3. Eligibility
By using the Interface, you represent and warrant that:
- You are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher)
- You have the legal capacity to enter into these Terms
- You are not a Restricted Person
- You are not using the Interface to evade any sanctions regime or to facilitate unlawful activity
- Your use of the Interface does not violate any law, regulation, or contract in your jurisdiction
4. Restricted Jurisdictions
You may not access the Interface from, and you may not use the Interface if you are a citizen or resident of, any of the following jurisdictions:
- Cuba
- Iran
- North Korea (DPRK)
- Syria
- Russia
- Belarus
- Myanmar (Burma)
- Venezuela
- The Crimea, Donetsk, Luhansk, Kherson, and Zaporizhzhia regions of Ukraine (as identified from time to time by OFAC)
- Any other jurisdiction subject to comprehensive sanctions by the United States, European Union, United Kingdom, or United Nations
The 9MM Pro team reserves the right to update this list at any time. We use the on-chain Chainalysis Sanctions Oracle and IP-based geolocation to enforce these restrictions.
5. Acceptable Use
You agree not to:
- Use the Interface for any unlawful purpose, including money laundering, terrorist financing, sanctions evasion, or fraud
- Manipulate markets, engage in wash trading, or coordinate pump-and-dump activity
- Exploit bugs, vulnerabilities, or unintended contract behavior
- Attempt to gain unauthorized access to the Interface, the Protocol, or any infrastructure
- Scrape, mirror, or reverse-engineer the Interface without written permission
- Use automated tools (bots, scripts) against the Interface without written permission, except for the documented public APIs (such as
index-api.9mm.pro) within their rate limits - Impersonate 9MM Pro or its team members
- Circumvent geoblocking, IP filtering, or wallet screening controls
6. Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Interface for personal, non-commercial purposes, subject to these Terms. This license does not include the right to redistribute the Interface, build competing products on top of it, or use 9MM Pro trademarks without permission.
7. Fees and Taxes
- Protocol fees are set and collected by the Protocol smart contracts; see Fees
- Network gas fees are set by the underlying blockchain and are paid directly to validators / miners
- You are solely responsible for determining and paying any taxes applicable to your use of the Interface and the Protocol — including capital gains, income, VAT, sales, and any other taxes in your jurisdiction
- 9MM Pro does not withhold, report, or assist with tax reporting, except where required by law
8. Intellectual Property
The 9MM Pro brand, logos, copy, and original content are the property of the 9MM Pro team. Smart contract source code is open source — the V2 / V3 DEX contracts are a fork of PancakeSwap, the 9x aggregator is a fork of 0x, each licensed under the respective upstream terms. Front-end source code availability is documented at github.com/9mm-exchange.
9. Third-Party Services
The Interface may link to or integrate with third-party services — wallet providers, RPC endpoints, block explorers, analytics platforms, bridges, and fiat on-ramps. Your use of these services is governed by their respective terms and privacy policies. 9MM Pro does not endorse or assume responsibility for third-party services.
10. Disclaimers
THE INTERFACE, THE PROTOCOL, AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF DATA, FREEDOM FROM BUGS OR DEFECTS, OR UNINTERRUPTED OPERATION.
No oral or written information obtained from 9MM Pro or through the Interface creates any warranty not expressly stated in these Terms.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, in no event shall 9MM Pro, its team, affiliates, contractors, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, lost funds, business interruption, or reputational harm — arising from or related to your use of (or inability to use) the Interface or the Protocol.
In any event, the aggregate liability of 9MM Pro and its affiliates to you for all claims shall not exceed the greater of (a) one hundred U.S. dollars (USD $100) or (b) the amount of fees you paid to 9MM Pro in the twelve months preceding the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless 9MM Pro, its team, affiliates, contractors, and contributors from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising from your use of the Interface, your breach of these Terms, your violation of any law, or your infringement of any third-party right.
13. Dispute Resolution
PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
This section requires that disputes be resolved by binding individual arbitration and waives your right to a jury trial and to participate in class actions. You may opt out within 30 days of first accepting these Terms.
13.1 Informal Resolution
Before initiating formal proceedings, you and 9MM Pro agree to attempt to resolve any dispute informally by contacting us in writing at legal@9mm.pro. The party raising the dispute must describe the issue and the requested resolution. If the dispute is not resolved within 60 days of the initial notice, either party may proceed to formal arbitration.
13.2 Binding Arbitration
Any dispute arising out of or relating to these Terms, the Interface, or the Protocol shall be resolved by binding individual arbitration administered by JAMS in accordance with its then-current Streamlined Arbitration Rules and Procedures (or, for claims exceeding USD $250,000, its Comprehensive Arbitration Rules and Procedures). The arbitration shall be conducted in Wilmington, Delaware, United States in the English language, before a single arbitrator.
13.3 Class Action Waiver
You and 9MM Pro agree that any dispute will be brought only in your individual capacity, not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one party's claims.
13.4 Jury Trial Waiver
Each party waives any right to a jury trial in any proceeding arising from or related to these Terms.
13.5 Mass-Arbitration Protocol
If 25 or more similar arbitration demands are filed within a 30-day window by claimants represented by the same or coordinated counsel, those claims shall be administered as a batched proceeding under the JAMS rules then in effect for mass arbitrations, with bellwether selection and staged filing fees as the arbitrator directs.
13.6 Opt-Out
You may opt out of the arbitration and class-action waiver provisions of this Section 13 by sending written notice to legal@9mm.pro within 30 days of first accepting these Terms. Your notice must include your wallet address, a statement that you opt out, and your signature. Opting out does not affect any other provision of these Terms.
14. Governing Law
These Terms and any dispute arising from them shall be governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Subject to Section 13, the state and federal courts located in Wilmington, Delaware shall have exclusive jurisdiction over any matter not subject to arbitration.
15. Termination
We may suspend or terminate your access to the Interface at any time, with or without notice, for any reason — including your breach of these Terms, suspected unlawful activity, or changes in applicable law. Smart contract access is permissionless and cannot be terminated by 9MM Pro.
16. Modifications
We may update these Terms from time to time. Material changes will be announced via the official Telegram and the 9MM Pro X account. Continued use of the Interface after an update constitutes acceptance of the updated Terms.
17. Miscellaneous
- Severability — if any provision is held unenforceable, the remaining provisions remain in effect
- Assignment — you may not assign your rights under these Terms; we may assign ours at any time
- Entire Agreement — these Terms, together with any referenced policies, constitute the entire agreement between you and 9MM Pro regarding the Interface
- No Waiver — failure to enforce a provision is not a waiver of that provision
- Notices — notices to you may be delivered by posting on the Interface or by any method reasonably calculated to provide notice
